These terms govern the sale and purchase of products and services through the T Mart platform. They complement and are read together with:
· The Terms of Use of the platform.
· The Privacy Policy.
· The Cookies Policy (recommended to be issued).
· The Sellers Agreement (internal, binding Tuwaiq Mart Company For Telecommunications and IT with each seller).
In the event of any conflict, these terms shall take interpretive priority specifically with respect to sales operations.

T Mart is an electronic display and marketing platform. When you purchase a product through the platform, the sale contract is concluded directly between you and the seller, not between you and T Mart.

The products and services offered on T Mart are divided into three tiers, each clearly identified on the product page:

A label is affixed to each product clarifying its category (e.g., "Sold and Shipped by T Mart" or "Sold by [Local Seller Name]" or "Sold by an International Seller — customs duties may apply").

· The base currency of the platform is the Saudi Riyal (SAR).
· Prices may be displayed in other currencies (such as USD) to facilitate international customers, but the final settlement is in Saudi Riyals.
· All prices displayed on the platform are inclusive of 15% Value Added Tax unless explicitly stated otherwise.
· The tax invoice is issued in accordance with the requirements of the Zakat, Tax and Customs Authority (ZATCA).
· A seller registered for VAT is required to issue an electronic tax invoice in the approved e-invoicing format (Phase 2 — Integration).
· Prices are subject to change at any time before the order is confirmed.
· After the order is confirmed and paid, the agreed price is binding.
· In the event of a clear pricing error (such as a zero price or an unreasonably low price due to a technical glitch):
· T Mart or the seller reserves the right to cancel the order before shipment.
· The full amount is refunded to the buyer.
· The buyer is notified and offered the option to complete the order at the correct price.
· Promotional offers have specific durations and conditions.
· Combining more than one offer is not permitted unless explicitly stated.

· You select the product and add it to the cart.
· You complete the shipping and payment information.
· You receive an electronic confirmation message (email and/or SMS) upon successful order.
· The contract is considered concluded at the moment the seller receives the order and confirms acceptance electronically (via the platform).
· Sending the order by the buyer = offer.
· The seller's confirmation of the order = acceptance.
· Before the seller's confirmation, either party has the right to cancel the order without liability (the amount is refunded).
Any order may be rejected for reasons including:
· Product is out of stock.
· Doubt about the validity of the buyer's information or the payment method.
· Buyer's violation of the Terms of Use.
· Existence of export/import restrictions on the product for the requested destination.

· Your card data is not stored on our servers. Processing is fully handled via the approved Tap Payments gateway.

· All transactions are settled in Saudi Riyals (SAR).
· In the case of payment by card in a foreign currency, your bank may apply Foreign Exchange fees.
· You will receive an electronic tax invoice at your registered email after payment is completed.

· We ship within the Kingdom of Saudi Arabia and globally via approved shipping partners.
· International shipping destinations are subject to import restrictions in the receiving country (the buyer is responsible for verification).
· Within the Kingdom: approved shipping partners (such as Saudi Post SPL, Aramex, SMSA, Toroad shipping platform).
· Outside the Kingdom: international shipping companies (DHL, FedEx, Aramex International, or similar).
· The choice of shipping company is made based on destination/country/city/region/and the size/weight of the shipment.
· Within the Kingdom: shipping may be free as part of promotional offers, or fees are calculated on the checkout page before confirmation.
· Outside the Kingdom: fees are calculated based on destination/country/city/region/and the size/weight of the shipment and are displayed before confirmation.
· Customs duties and taxes in the receiving country are the responsibility of the buyer and may be requested upon receipt of the shipment.
· Within the Kingdom: typically 2-7 business days depending on the region and product type.
· Outside the Kingdom: typically 7-21 business days depending on the destination.
· The periods are estimates and not binding. Shipping delays due to customs or circumstances beyond our control are not considered a breach of contract.
· The buyer is required to inspect the shipment upon receipt and report any visible damage within 48 hours of receipt.
· Signing the receipt without reservation is considered an acknowledgment of receiving the shipment in apparently good condition.
· For high-value products (vehicles, real estate, shipments exceeding SAR 5,000 in value): the recipient may be asked to present a valid national ID or residency permit matching the name of the order owner for verification and fraud prevention purposes.
In the event of failed delivery due to the buyer (wrong address, no response, refusal to receive without justification):
· The shipment is returned to the seller.
· The buyer may be charged for the return shipping fees.
· The price of the product is refunded after deducting the shipping costs incurred.

We apply a tiered return policy based on the type of product:

In accordance with the E-Commerce Law and its Implementing Regulation, the right of return/withdrawal does not apply to:

1. Contact via Refund@Tuwaiqmart.com within the specified period.
2. Attach the order number, the reason for return, and photos of the product (if possible).
3. Receive the Return Merchandise Authorization (RMA) ticket number.
4. Ship the product according to the instructions.
5. Product review (typically 5 business days).
6. Refund the amount via the same original payment method.

· No specific period within the warranty period (if any).
· The buyer has the right to request: repair, replacement, or full refund.

· Payment Card: refund to the same card (3-14 business days depending on the bank).
· Bank Transfer: refund to the bank account from which the transfer was made (3-7 business days).
· Platform Wallet: a refund may be made available as a balance in your platform account (when this feature is available).
· The full Value Added Tax paid is refunded.
· The seller issues a tax Credit Note in accordance with ZATCA requirements.
· If the return is at the buyer's desire without a defect, the original shipping fees and the return shipping cost may be deducted.

· New products are subject to the manufacturer's warranty (if any).
· Used products (such as vehicles) are subject to the warranty explicitly declared by the seller.
· The seller is bound by the Saudi Consumer Protection Law in everything related to hidden defects and replacement.
· We guarantee the safety of the payment process via our gateway.
· We guarantee the refund of your money in the event the seller does not fulfill the order despite payment (Buyer Protection — recommended to be officially activated).
· We do not provide a direct warranty on products as we are not the seller.

· Our platform is for over-the-counter (OTC) health products and approved medical devices only.
· We do not market prescription (Rx) medicines.
· The seller responsible for the product must be licensed by the Saudi Food and Drug Authority (SFDA).
· Products do not replace specialized medical consultation.
· Listings come from real estate sellers/brokers.
· Real estate brokers are required to be licensed by the Real Estate General Authority (REGA) and to hold an approved Advertising License (FAL).
· The buyer is responsible for verifying the title deeds and the soundness of the property before any transaction.
· Final real estate transactions (transfer of ownership, contract notarization) take place outside the platform through official authorities.
· T Mart is an advertising platform only and does not bear responsibility for the real estate contract itself.
· The vehicles offered are from licensed showrooms/individuals.
· The seller provides a description of the condition, mileage, and inspection report (if any).
· The buyer is responsible for conducting an independent technical inspection before completing the purchase.
· The transfer of vehicle ownership takes place via Absher / the Traffic Department in the presence of both parties or their representatives.
· The "return" period after the transfer of ownership is limited to material hidden defects in accordance with what the seller declares.
· Subject to the auction system on the platform.
· Transfer is via Absher.
· The seller guarantees the plate is free of violations.
· Government plate transfer fees are at the buyer's expense.
· After completing the transfer via the MoI, no return is permitted.
· Subject to the requirements of the Ministry of Environment, Water and Agriculture (MEWA).
· The seller is required to provide a veterinary health certificate for the animal.
· Shipping the animal is via specialized shipping companies only.
· No return is permitted after delivery except in the case of proof of illness in writing by an accredited veterinary certificate within 7 days.
· The seller is bound by the requirements of the Saudi Food and Drug Authority + the municipal license.
· No return is permitted for fresh food after receipt except in the case of visible damage or expiration.
· Quality reports are processed within 24 hours of receipt.
· A digital product non-returnable after the code has been issued.
· The card validity is specified on the product page.
· The card balance is not converted to cash.

1. Direct communication between the buyer and the seller first.
2. In the event of disagreement, file a complaint with T Mart via Complains@Tuwaiqmart.com within 30 days from the date of the incident.
3. The period to attempt resolution between the seller and buyer before judicial escalation = 45 days from the date of opening the dispute. During this period:
· T Mart provides a mediation service between the parties.
· Tuwaiq Mart Company For Telecommunications and IT can freeze the disputed amounts.
· The seller is required to respond to the complaint within 5 business days.
4. The mediation service is not a court and its decisions are not judicially binding.
5. In the event of no resolution after 45 days, either party has the right to:
· File a report with the Ministry of Commerce via the Commerce Report (1900).
· Resort to the competent Saudi courts.
· In the event of an active dispute, Tuwaiq Mart Company For Telecommunications and IT has the right to hold the amount transferred from the buyer to the seller until the dispute is decided.
━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━
In the event of force majeure circumstances (disasters, wars, epidemics, government closures, etc.) that prevent the fulfillment of obligations:
· The party is exempted from liability.
· Contractual periods are extended by the duration of the impediment.
· If the impediment continues for more than 60 days, either party has the right to terminate the contract and recover what was paid.

To the maximum extent permitted by Saudi law:
· Tuwaiq Mart Company For Telecommunications and IT bears no liability for any indirect, consequential, incidental, or special damages arising from the purchase (such as loss of profits, loss of data, loss of opportunity).
· Our cumulative liability in any case shall not exceed:
· (a) the value of the order subject of the dispute, or
· (b) what you actually paid to the platform in the last 12 months,
· whichever is less.

· These terms are subject to the laws of the Kingdom of Saudi Arabia, including in particular:
· The E-Commerce Law and its Implementing Regulation.
· The Consumer Protection Law.
· The Anti-Commercial Concealment Law.
· The Personal Data Protection Law (PDPL).
· The Value Added Tax Law.
· Disputes shall be resolved amicably as much as possible.
· If resolution is not possible, the competent Saudi courts have jurisdiction over the dispute.
· This does not prejudice the consumer's right to apply to:
· The Commerce Report (1900) of the Ministry of Commerce.
· The Consumer Protection Authority.

· Tuwaiq Mart Company For Telecommunications and IT reserves the right to modify these terms at any time.
· Substantial modifications are notified to users via the registered email 30 days in advance.
· Orders submitted before the effective date of the modification are subject to the terms in force at the time of the order.
